South Lake Tahoe Man Pleads Guilty To Receiving And
Possessing Child Pornography
SACRAMENTO--United
States Attorney McGregor W. Scott announced today
that DAVID KEARBY CLEMENTS, 50, of South Lake Tahoe,
California, pled guilty today to four counts of receiving
child pornography over the Internet and one count
of possession of child pornography before United States
District Judge Frank C. Damrell, Jr.
This
case was investigated by the Federal Bureau of Investigation,
the South Lake Tahoe Police Department, and the California
Highway Patrol.
According
to Assistant United States Attorney Michelle Rodriguez,
who is prosecuting this case, CLEMENTS possessed over
65 images of child sexual abuse. CLEMENTS agreed to
forfeit all of his computer equipment which he used
to receive and possess sexually explicit images of
minor females.
CLEMENTS
faces a minimum sentence of five years imprisonment
and a maximum of 20 years imprisonment for each receipt
of child pornography offense and ten years imprisonment
for possession of child pornography. After completion
of any term of imprisonment, CLEMENTS faces a term
of federal supervised release of up to life, a sex
offender registration condition, and a fine of up
to $1,250,000. However, the actual sentence will be
determined at the discretion of the court after consideration
of the Federal Sentencing Guidelines, which take into
account a number of variables, and any applicable
statutory sentencing factors.
CLEMENTS
is scheduled to be sentenced by Judge Damrell on March
17, 2008, at 10:00 a.m.
